  11. Please read the terms and conditions of this Freeware Licence
  12. Agreement carefully, in particular the restrictions contained
  13. within and the disclaimers and limitations of liability of use.

  16. GRANT OF LICENCE
  17. This Licence Agreement ("Licence") sets out the legal terms and
  18. conditions upon which we, Cascata Limited & MobileWizardry
  19. Limited ("Creators"), permit You to install and use the PDA
  20. version of the interactive computer game Master Thief(tm)
  21. ("Software"). ("You") means the individual downloading, and
  22. paying (where applicable) for the right to install and use the
  23. freeware SOFTWARE.
  24.  
  25. The Freeware Software is licensed, not sold. By installing,
  26. copying or otherwise using the SOFTWARE, you agree to be bound by
  27. the terms of this Agreement. If you do not agree to the terms of
  28. this Agreement, promptly return the complete product unopened or
  29. uninstalled using the Returns procedure at the merchant or
  30. supplier from whom you purchased the SOFTWARE.

  33. The minimum requirements required in order for you to be able to
  34. install and use the Software are stated on the merchant Website.
  35.  
  36. You are solely responsible for ensuring that your PDA meets the
  37. Minimum Requirements. You will not be able to install and/or use
  38. the Software unless your PDA meets the Minimum Requirements.
  39. Creators reserves the right to retain any payment made in respect
  40. of the Software in the event that You attempt to install and/or
  41. use the Software on a PDA which does not meet the Minimum
  42. Requirements.

  46. FREEWARE PRODUCT TRANSFER
  47. User may permanently transfer the entire Freeware Product to any
  48. third party, providing that the third party accepts the terms of
  49. this EULA in its entirety.

  51. In the event that User has received this Freeware Product as part
  52. of a Freeware Bundle, then all Freeware Products supplied as part
  53. of that Freeware Bundle must be transferred. Under no
  54. circumstances can a Freeware Product supplied as part of a
  55. Freeware Bundle be transferred separately.
  56.  
  57. Please note that this is a legally binding agreement. If you do
  58. not agree to be bound by its terms do not proceed to install the
  59. SOFTWARE. If you are prepared to be bound by these terms and
  60. conditions after having read them carefully please click onto the
  61. "I Agree" button at the end of this Licence Agreement. By doing
  62. so you will be agreeing to be legally bound by the terms of this
  63. Licence Agreement.

  67. FURTHER CONDITIONS OF LICENSE
  68. The Creators may at any time and without notice or warning change
  69. the contents and technical specifications of the Software as the 
  70. companies sees fit. Without prejudice to the generality of the 
  71. foregoing, the Creators do not guarantee the availability of the 
  72. SOFTWARE on the Website for any period of time. 
  73.  
  74. The rights and licences granted to you in this Licence Agreement
  75. are personal to You. This Licence Agreement and the rights
  76. granted to you under it are for your benefit only and are not
  77. transferable or assignable. 
  78.  
  79. You may only use the Software for your own personal and
  80. non-commercial leisure use. 
  81.  
  82. Except for the rights expressly set out in this Licence
  83. Agreement, all rights (including intellectual property rights)
  84. in relation to the Software and the game comprised therein are
  85. reserved absolutely by the respective named owners of such 
  86. rights. Except as expressly permitted by this Licence Agreement 
  87. and save and to the extent expressly permitted by applicable law, 
  88. you may not rent, lease, sub-license, exploit for gain, copy,
  89. modify, adapt, merge, translate, reverse engineer, decompile,
  90. disassemble or create derivative works based on the whole or any
  91. part of the SOFTWARE or use, reproduce or otherwise deal in the
  92. Software or any part thereof in any way.

  94. To the maximum extent permitted under law, if during the warranty
  95. period set forth below, a defect is discovered by User, UserÆs
  96. exclusive remedy hereunder shall be, at the sole option of the
  97. Creators the repair or replacement of the Freeware Product. In
  98. order to obtain such remedy, User must return the Freeware
  99. Product in its entirety to the Creators, for a replacement copy.

  103. TRADEMARK & COPYRIGHT
  104. The SOFTWARE (including any images and text incorporated into the
  105. SOFTWARE) is jointly owned by Cascata Limited & MobileWizardry
  106. Limited, their suppliers. The Software is protected by English
  107. copyright laws and international treaty provisions.
  108.  
  109. Master Thief(tm) & Cascata(tm) are registered UK Trade Marks.

  113. BACKUP & OTHER PRECAUTIONS
  114. You may take a single back-up copy of the SOFTWARE and are solely
  115. responsible for making such back-up copy. We are not liable to
  116. You for any loss of the SOFTWARE or inability to play the game
  117. comprised therein as a result of a loss of power and/or failure
  118. to make a back-up copy of the SOFTWARE.
  119.  
  120. You may not use the back-up copy of the SOFTWARE for any purpose
  121. other than to reproduce the original in the event that it is
  122. destroyed or becomes defective. 
  123.  
  124. In addition, we accept no liability to You in the event that
  125. there is any defect or failure in the operation or use of the
  126. SOFTWARE as a result of any corruption of data or otherwise
  127. Caused by any other application on the PDA.

  131. DISCAIMERS & EXCLUSIONS & LIMITATIONS ON LIABILITY
  132. Cascata Limited & MobileWizardry Limited warrants that this
  133. SOFTWARE will perform substantially in accordance with the user
  134. instructions for a period of ninety days from the date of
  135. receipt. 
  136.  
  137. We do not make any representation or warranty as to the quality,
  138. functionality or freedom from error or contaminants (including
  139. viruses, worms, Trojan horses, logic bombs or similar) or
  140. availability of the SOFTWARE or the Website. Our entire liability
  141. shall be, at Cascata Limited's option, either (a) return of the
  142. price paid or (b) repair or replacement of the SOFTWARE that does
  143. not meet our warranty.

  145. So far as permitted by law, You agree that all implied
  146. warranties, conditions and terms of any nature, including
  147. without limitation warranties of satisfactory quality,
  148. merchantability or fitness for purpose, relating to the SOFTWARE
  149. are hereby excluded and that You download, install, use (as the
  150. case may be) the SOFTWARE and the computer game comprised therein
  151. entirely at your own risk.

  153. The Creators recommends that You employ an up-to-date virus scan
  154. program before downloading, installing and/or using the SOFTWARE.
  155.  
  156. THE MAXIMUM EXTENT OF OUR LIABILITY TO YOU, WHETHER IN CONTRACT,
  157. TORT (INCLUDING NEGLIGENCE) OR HOWSOEVER ARISING UNDER OR IN
  158. RELATION TO THIS LICENCE, SHALL NOT IN AGGREGATE EXCEED THE FEE
  159. PAID OR PAYABLE BY YOU TO DOWNLOAD, INSTALL AND USE THE SOFTWARE.

  161. YOU AGREE THAT NEITHER WE NOR ANY RIGHTS OWNER IN THE SOFTWARE OR
  162. THE GAME COMPRISED IN IT SHALL IN ANY EVENT, TO THE MAXIMUM
  163. EXTENT PERMISSIBLE BY LAW, BE LIABLE TO YOU OR ANY OTHER PARTY
  164. (NEITHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE)
  165. FOR ANY LOSS OF PROFIT, GOODWILL, REPUTATION OR OPPORTUNITY OR
  166. FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL OR SPECIAL LOSS OR
  167. DAMAGE ARISING FROM YOU DOWNLOADING, INSTALLING AND/OR USING THE
  168. SOFTWARE AND PLAYING THE GAME COMPRISED THEREIN).

  172. GOVERNING LAW & JURISDICTION
  173. The construction, validity and performance of this Licence shall
  174. be governed in all respects by English law and You agree to
  175. submit to the non-exclusive jurisdiction of the Courts of England
  176. in relation to any suit, action or proceeding relating to or
  177. arising in connection with this Licence.
